7.6 In the event that the buyer does not pick up the goods on the agreed delivery date or if the seller does not inform the seller in a timely manner of a delivery address, the seller has the right to postpone the delivery date and arrange the storage of the goods at the risk and at the buyer`s expense, or to cancel the order or part of that merchandise without any liability, and the buyer cannot guarantee any claim. 14.3 The buyer will keep all confidential and commercial information he receives from the Seller. This confidentiality provision applies for an indeterminate period, regardless of the reason for termination, even after the termination of a supply contract. The duty of confidentiality does not apply to information obtained legally by the purchaser at the time of disclosure, provided that such information has not been subject to a duty of professional secrecy or (ii) that the purchaser subsequently obtained independently and lawfully without being required to treat it confidentially, or (iii) that such information is or is known to all without the purchaser obtaining a breach of contract. 3.1 Until the seller has obtained the buyer`s approval, the seller has the right to accept with third parties the products offered to the buyer, so that the seller`s offer no longer exists. When the buyer accepts the proposed merchandise from the seller after the seller has caved in with a third party on that merchandise, the seller must inform the buyer that the offer is no longer immediate and the buyer cannot guarantee damages. 7.4 Both parties are exempt from liability because they do not fulfill the contract because of these circumstances, see 11.3 If and to the extent that the person is delayed due to a case of force majeure, the contracting party is entitled to an extension for the delivery period. If delivery is temporarily delayed by one or more of the circumstances of point 11.3, the delivery date is postponed accordingly. The delivery period is extended by a period corresponding to the period of interruption caused by a force majeure event. If delivery is prevented for more than 12 weeks, the seller has the right to revoke the contract without liability.
7.3 The delivery date in the order confirmation is set by the Seller at his discretion and, if this cannot be met, the Buyer will be informed if possible the delivery is scheduled. Unless the parties agree, a postponement of the delivery date up to 14 days schedule is always a timely delivery and does not give the buyer the right to cancel the purchase or contract and/or ask the seller for any form of financial compensation.
